These Terms of Service ("Terms") govern your use of the Muirhead Memorial Cemetery website and services (collectively, the "Services"). By accessing or using our website, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our Services.

Use of Our Services

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Services in any way that violates applicable federal, state, or local laws or regulations.
• Attempt to gain unauthorized access to any portion of the website, other accounts, or computer systems.
• Interfere with or disrupt the Services, servers, or networks connected to the Services.
• Submit false, misleading, or fraudulent reservation requests.
• Use the Services to transmit viruses, malware, or any other malicious code.
• Reproduce, duplicate, or resell any part of the Services without express written permission.

Plot Reservations & Payment Plans

• All plot reservations are subject to review and approval by Muirhead Memorial Cemetery management.
• Submission of a reservation request does not guarantee availability or approval.
• Payment plans (6-month and 12-month) include a 5% interest charge applied to the total purchase price.
• Down payments are due upon approval of your reservation. Monthly payments must be made according to the agreed schedule.
• Failure to make timely payments may result in cancellation of your reservation and forfeiture of deposits, subject to Texas law.
• Approved reservations represent a license to use the designated plot and do not constitute ownership of the underlying land.
• All plot assignments are subject to cemetery rules, regulations, and applicable zoning and burial laws.

User Accounts

• To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate, current, and complete information during registration and update it as necessary.
• You are responsible for all activities that occur under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or are associated with fraudulent or unlawful activity.

Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Muirhead Memorial Cemetery or its licensors and is protected by U.S. copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

Limitation of Liability

To the fullest extent permitted by law, Muirhead Memorial Cemetery and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Services. Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you have paid us through the Services.

Plot availability, pricing, and specifications are subject to change without notice. We make no guarantees regarding the availability of any specific plot until a reservation is formally approved.

Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure. Your use of the Services is at your own risk.

Indemnification

You agree to indemnify and hold harmless Muirhead Memorial Cemetery and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Montgomery County, Texas.

We reserve the right to modify these Terms at any time. We will post updated Terms on this page with a revised "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the updated Terms.
